But even if no such codelist existed then this would in no way be a reason not to use DCAT. In that case such skos:Concepts would simply have to be created. But that does not seem to be necessary because several such collections or skos:ConceptSchemes exist.
One of them is published and maintained by the Publications Office of the European Union: The Administrative territoral units NAL (http://publications.europa.eu/mdr/authority/atu/index.html). Bavaria for example has this URL http://publications.europa.eu/resource/authority/atu/DEU_LD_BY (dereferencing does not work correctly, that is a known issue which will be resolved. I am in contact with the person in charge).
Another one is published and maintained by the Deutsche Nationalbibliothek (http://d-nb.info/standards/vocab/gnd/geographic-area-code.html). Bavaria is http://d-nb.info/standards/vocab/gnd/geographic-area-code#XA-DE-BY
And there are more... The real difficulty is to evaluate and decide which ones are best and should be recommended. But that is no excuse to create something new which is not even compatible with DCAT.

OGD 2.0 should indeed go with one of the existing schemes!
